A 60-year-old man has gone on trial 2007-03-23 at ‘The High Court’ in Edinburgh accused of raping and murdering a 23 year old female Polish student.

The murder charge alleges that between 2006-09-24 & 2006-09-29, Peter Tobin gagged Angelika Kluk with cloth and tape, tied her hands, raped her and battered her on the head with a piece of wood or something similar, and repeatedly struck her with a knife before hiding her dead body below a hatch in the floor of the church in an attempt to defeat the ends of justice.

A further charge, alleges that he gave Glasgow police a false name, age and address, travelled to London and pretended to staff at ‘The National Neurology & Neurosurgery Hospital’ in Queen’s Sq., London, that his name was James Kelly.

Mr.Tobin denies both charges. However, in a ‘special defence’ read to the jury he admitted having sex with the Polish student, with her consent. Mr.Tobin also denies a breach of the peace between 2006-07 & 2006-09 by threatening Ms. Rebecca Dordi at St Patrick’s Church. The trial before Judge Lord Menzies is expected to last about six weeks.

The judge told the jury the case had attracted a lot of press coverage but they must listen carefully to the evidence presented in court.
